Terms and Conditions for Participation
By submitting artwork to this call, I confirm that:
- Original Work: The submitted artwork is my original creation, and I hold all copyright and intellectual property rights.
- Exhibition Usage: I grant permission for my artwork to be displayed in the Eastover Contemporary Art Space and the Art in the Berkshires online gallery from June 2025 through December 2025.
- Promotional Use: I consent to my artwork being used for promotional purposes related to the exhibition, including advertising, print materials, and digital media.
- Sales Agreement: If selected, my artwork will be for sale during the exhibition and online gallery. I agree to the 70% artist / 30% Art in the Berkshires sales split for any artwork sold during these periods. If sold outside these channels during the show period, I will provide a 15% referral fee to Art in the Berkshires.
- Artist Responsibility: I am responsible for delivering and installing my artwork, as well as any insurance coverage for the artwork during transit and exhibition.
- Compliance: I understand and accept the eligibility requirements and guidelines outlined in the prospectus.
- Hold Harmless Clause: I agree to hold harmless Art in the Berkshires, its sponsors (including Eastover Eco-Village and REC Foundation), curators, support staff, and volunteers from any claims, damages, losses, or liabilities arising from participation in this exhibition. This includes, but is not limited to, damage, theft, or loss of artwork during transit, installation, exhibition, or removal.
